Neighbors Face £250K Bill in Garden Boundary Dispute

A dispute over garden boundaries between neighbors has led to a costly court case, where siblings may face a substantial bill of nearly a quarter of a million pounds. The issue arose when Robert McCarthy and his wife Amanda clashed with their neighbors, Foulla Bowler and her siblings, over a row of 33-foot Leylandii trees that were cut down due to overshadowing concerns.

The court ruled in favor of the McCarthys, determining that the siblings trespassed into their neighbors’ garden to remove the trees. The judge highlighted the “ruinous” nature of the boundary dispute, emphasizing the significant financial implications for the siblings, who may be responsible for the legal costs, damages, and compensation amounting to around £250,000.

The conflict escalated when Mrs. Bowler and her siblings unilaterally removed the trees and disputed the property boundary. Despite claims that the trees were causing overshadowing and potential damage, the court found that the original fence line represented the true boundary, placing the Leylandii trees within the McCarthys’ property.

The judge criticized the siblings for their actions, noting that they disrupted a longstanding agreement on the boundary that had been in place for decades. The case will proceed to determine the full extent of the consequences for the siblings, including compensation and additional legal expenses.
