A judge has stated that determining the father of a child born to a woman who had relations with two identical twins within a short time frame is deemed ‘impossible’. The birth certificate of the child, identified in court as ‘P’, initially listed one of the twins as the father, but it was revealed that either of the brothers could equally be the father. The other twin and the mother sought to assume parental responsibilities by appealing a previous decision, but the court ruled that the listed father would temporarily lose those responsibilities pending further legal proceedings.
The judge emphasized that current DNA testing cannot differentiate between the twins, leaving a 50% chance that the correct father is already recorded on the birth certificate. He expressed optimism that future advancements in paternity testing may provide clarity before the child reaches adulthood.
In a recent judgment, it was highlighted that the child’s paternity could only be attributed to one of the identical twins, with no definitive distinction between them. The court found that both brothers had engaged in intimate relations with the woman around the time of conception, making it equally probable for either brother to be the father.
While the first twin was initially registered as the father, the court ruled that his parental responsibilities would be suspended. However, the judge clarified that there was insufficient evidence to conclusively exclude him as the father.
The judge underscored the importance of proving facts and the distinction between lack of proof and affirmatively disproving a claim.
