“Legal Challenge Threatens Car Finance Compensation Delays”

Millions of drivers are facing potential delays in receiving compensation for car finance deals following a legal challenge. Consumer Voice, a consumer group, is seeking a review of the Financial Conduct Authority’s compensation scheme, arguing that it may leave many consumers under-compensated. The scheme is estimated to result in approximately £7.5 billion in payouts, with total costs projected to reach £9.1 billion.

Consumer Voice is planning to submit paperwork to the upper tribunal to challenge the scheme, emphasizing the need for fair compensation that accurately reflects the harm suffered by drivers. They criticize the exclusion of many consumer complaints from receiving full redress under the current scheme.

Alex Neill, co-founder of Consumer Voice, expressed concerns that the current scheme could leave millions of drivers financially disadvantaged and called for a fair resolution. The group believes that consumers have already been let down by lenders and should not face further injustice due to regulatory shortcomings.

The Financial Conduct Authority defended its scheme, stating it is the quickest and fairest way to compensate consumers. However, critics, including James Daley from Fairer Finance, fear that challenging the scheme could prolong the process and cause further delays in payouts.

The compensation scheme covers car finance agreements made between April 6, 2007, and November 1, 2024, involving commission payments. Consumers may have been mis-sold if their agreements had certain undisclosed arrangements or high commission rates. The FCA anticipates an average compensation of around £700 per agreement, although individual circumstances may vary.

The recent decision to tighten eligibility criteria for redress means that fewer drivers will be eligible, but those included may receive higher payouts.
